Tallycart Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Tallycart mobile application, our website at tallycart.io, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.


1) Definitions
"Account" means your user account for the Service.
"Receipt Photo" means an image of a grocery receipt you submit for processing.
"Receipt Data" means the extracted output we store in your account (store name, receipt date, item names, and item prices).
"Subscription" means a paid plan that provides access to the Service.
"User Content" means content you submit through the Service (including Receipt Photos).


2) Eligibility
Age Requirements (13+)
You must be at least 13 years old to use the Service. If you are between 13 and 17, you may use the Service only with the consent and supervision of a parent or legal guardian, who agrees to be responsible for your use of the Service.


3) Account Registration and Responsibility
An Account is required (no guest mode). You agree to provide accurate information and keep your Account secure. You are responsible for all activity that occurs under your Account.


4) What the Service Does
No Guaranteed Results
Tallycart helps you track grocery spending by extracting and organizing Receipt Data, and by showing budget progress and forecasts based on your spending history and the budget you set.
No guaranteed savings: We do not guarantee that you will save money or achieve any financial outcome by using the Service. Results depend on your habits and real-world spending.
Not financial advice: The Service provides informational tracking and budgeting tools and does not provide financial, legal, or tax advice.


5) Receipt Processing and Data Handling


5.1 Receipt Photos are not stored
Receipt Photos are processed in memory only and deleted immediately after processing completes. We do not store Receipt Photos in our database or persistent storage.


5.2 What we store
We store Receipt Data in your Account so you can view your receipt history and tracking over time. Receipt Data includes:

  • store name

  • receipt date

  • item names

  • item prices


5.3 Third-party processing
To provide receipt extraction and verification, we use third-party services, including:

  • AI verification: Anthropic Claude API (we send receipt images to the Anthropic API for text extraction and data verification; Anthropic processes this data subject to their own privacy policy at anthropic.com)

  • Hosting/database: Supabase

  • Subscription infrastructure: Adapty

  • Push notifications: Unity (used to deliver in-app and push notifications; Unity may process device identifiers necessary for notification delivery)

  • Analytics and crash reporting: Firebase (Firebase Analytics for tracking user interactions and behavior; Firebase Crashlytics for crash and error diagnostics)

  • Details about data categories, retention, and your rights are described in our Privacy Policy.


5.4 International data transfers

Some third-party providers listed above are based outside the European Economic Area (EEA), including the United States. Where we transfer your data outside the EEA, we rely on appropriate safeguards such as Standard Contractual Clauses (SCCs) or adequacy decisions. Details are provided in our Privacy Policy.


6) Accuracy Disclaimer
Receipt extraction, item detection, totals, and budget forecasts are automated and may be inaccurate or incomplete. You are responsible for reviewing your data and your spending decisions. We are not responsible for losses resulting from inaccurate extraction, merchant details, pricing, budgeting insights, or forecasts.


7) Subscriptions, Trials, Billing, and Refunds


7.1 Billing platforms
Subscriptions and in-app purchases are processed through third-party platforms such as Apple App Store and Google Play. Their terms govern payment processing, renewals, cancellations, and refunds.


7.2 Plans and promotions
Offers may include:

  • Annual: free trial for 7 days. Unless you cancel before the trial ends, the subscription will automatically convert to a paid annual plan and renew per the platform rules.


7.3 Auto-renewal and cancellation
Subscriptions automatically renew unless canceled through your platform account settings before renewal. You are responsible for managing cancellations.


7.4 Refunds
Purchases are processed by the platform, and the platform's refund policies apply. We do not provide refunds directly.


8) Acceptable Use and Prohibited Conduct
You agree not to:

  • Use the Service for unlawful purposes or in violation of applicable law

  • Upload content you do not have the right to use

  • Attempt to reverse engineer, scrape, copy, or circumvent security features

  • Interfere with or disrupt the Service (including automated abuse, excessive requests, or attempting to overload systems)

  • Access non-public areas or systems without authorization

  • Use the Service to build or benchmark a competing product through unauthorized means

  • Engage in fraud, chargeback abuse, or any activity that harms the Service or other users


9) User Content and Limited License (Service-only)
You retain ownership of your User Content. To operate the Service, you grant us a limited, non-exclusive, worldwide license to host, process, and use your User Content only as necessary to provide, maintain, and improve the Service (for example, processing Receipt Photos to produce Receipt Data). We do not publicly display your receipts or Receipt Data.


10) Intellectual Property
The Service (excluding User Content) and all associated software, designs, text, graphics, and trademarks are owned by us or our licensors and are protected by applicable laws. You may not copy, modify, distribute, sell, or create derivative works from the Service except as expressly permitted by these Terms.


11) Third-Party Services
The Service relies on third-party services and may include links or integrations. We do not control third-party services and are not responsible for their content, terms, or availability.


12) Termination
We may suspend or terminate your access immediately if you violate these Terms, misuse the Service, or create risk or legal exposure. You may stop using the Service at any time and delete your Account in-app.


13) "AS IS" and "AS AVAILABLE" Disclaimer
To the maximum extent permitted by law, the Service is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or fully accurate.


14) Limitation of Liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill.
To the maximum extent permitted by law, our total liability for any claim related to the Service will not exceed the amount you paid for the Service in the 12 months before the event giving rise to the claim.
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.


15) Indemnification
You agree to defend, indemnify, and hold us harmless from claims, liabilities, damages, and expenses (including reasonable legal fees) arising from your use of the Service, your User Content, or your violation of these Terms or applicable law.


16) Governing Law
Dispute Resolution
These Terms are governed by the laws of Romania, without regard to conflict of law rules.
Before filing a claim, you agree to contact us at contact@tallycart.io and attempt to resolve disputes informally. If a dispute cannot be resolved, disputes will be brought in the competent courts of Romania, unless mandatory consumer laws provide otherwise.
EU/UK consumers: If you are a consumer residing in the EU/UK, you may benefit from mandatory provisions of the law of your country of residence.


17) Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect.


18) Force Majeure
We are not liable for any delay or failure to perform the Service caused by events beyond our reasonable control, including natural disasters, war, terrorism, civil unrest, internet outages, infrastructure failures, government actions, or failures of third-party service providers.


19) Changes to These Terms
We may update these Terms from time to time. If changes are material, we will provide reasonable notice through the Service or by other means. Continued use after changes become effective means you accept the updated Terms.
